How do I go about getting back my security deposit?
I was renting a basement apartment from an acquaintance back in June. I gave her a months rent and one months security, no lease, just month to month. She always wanted cash and would never accept a check. She admitted to me that she wasn’t claiming it on her taxes. Being that it was a basement, I asked her if there were ever any problems with roaches and she said no.
I moved there in June when it still wasn’t that hot out so I didn’t see any bugs yet. During the middle of June I started to see bugs, BIG BUGS. I was completely grossed out. Then I started seeing them all over the sidewalks at night which clearly tells me that the neighborhood was infested. She knew how I felt about the bugs which is why she must have lied.
Around July 3rd I told her that I need to leave and she expected me to live out the rest of July and the security deposit for August. I told her no and that I would move out by the middle of July, and only ask for the security deposit. She told me that it’s not how it works and that she will not give me back my security deposit.
Later on I found out that the basement apartment was illegal. No smoke detectors, no back way out, 6 steps down and a gas stove. I vacated the apartment on the 14th. She was supposed to give me back my security deposit on the 22nd. Then she said she can only give me half. So I accepted half and she said I’d get the other half next week.
She just left me a message saying that she wants the keys back, but I don’t trust her. It’s not even the end of the month yet. What can I do to resolve this and get my full deposit back with as little hassle as possible. If she does give me further hassle, what measures do I need to take?

HELP WITH HORRIBLE EX LANDLORD!!!!! urgent, please answer!?
Here’s the situation. I moved into an apartment on March 15th 2007 and signed a year lease with a landlord who seemed pretty reasonable. there was no working front door lock before we moved and, and we were assured it would be fixed before we moved in. Two Months later after constant reminding he finally fixed the door. In the meantime, we learned that there were no smoke detectors in the apartment, when the weather was warm bugs infested the place, and i mean infested. They were everywhere, in my bed, every room. Awful. The kicken sink pipes leaked into the bedroom, the place was really a mess. Not to mention the landlord proved himself to be a drunk, and would fly off the handle at any given occassion when something seemed to set him off. He was convinced that we were loud tentants, because we came home at 11PM almost every night (we work in restaurants, and he knew this prior to us moving in). We asked to terminate the lease, and he had no problem allowing us out. In fact
he wrote us a letter saying that he contacted the police regarding out move out, and if we werent out by midnight on the 14th of this month we would be trespassing. Later that say (this was the 12th) he barged into our apartment cussing me out (im a 23 year old female) along with my boyfriend saying we better have our sh*t out of the apartment or else wed find it on the street. I called the police and filed a report after telling him I would do so if he didnt promptly leave (im 7 months pregnant, and all of these circumstances combined made me feel very unsafe living there) Well, we paid 0 in security, and I called him yesterday asking when it would be returned to us, at which point he went on to say that we owe him ,000 for the remainer of the rent even though he told us we could not step on the property or else we’d be trespassing, and writing us a letter stating that we MUST be out by midnight the 14th. I believe that he is only doing this to scare us out of persuing
the security deposit. He has no contacted us since, but I am thinking about taking him to court, to get our money back. Who would win this case in court??? Would we actually owe him money?? Im fed up with this guy, and glad to be out but I feel like IM being taken advantage of. Since moving out, Ive spoken with another tenant of his who is also moving out. SHe was told by a previous tenant that getting her security back would be next to impossible so to persue the issue as early as possible. On our lease it says upon termination of the lease, the security deposit must be returned within 10 days. HELP!!!!!
we have already settled into a new aparment and though our lease ran until the 15th of every month, I made sure that we were out by the afternoon of the 14th. I however, not well versed in tenant rights, and not thinking that this would have every been a problem did not take pictures of the conditions of the place before or after. We left it in perfect condition, better infact than before we moved in (we fixed a door that was falling off the hinges that he promised hed fix and didnt) and we had the bug exterminated twice, though neither time seemed to work for more than a week.

why dont my LL fix this?
my two daughters and husband and i have been living here for 3 months… there is lots of problems in this home , we have asked owner to pls fix problems , only one thing out of many have been repaired..the owners responce to this is i payed the repair guy the money to fix the problems ,the repair man dosent do anything thats all she says , its been 3 months and still there is mildew building up outside my front door from a leaky water outlet there is roted out dry wall in the house i have not one single smoke detector in the house or a fire extinguisher outside of the duplex. the counter tops are falling apart they move easly there is moldings around the house that need to be installed to help keep the bugs out, the water heater is not tied down properly i have 2 brocken windows, the carpet needs aluminum base covers on the edges to keep the nails in the floor from sticking into your feet, i have lights that do not work,the bathroom sink is still leaking and there is rodent decafetation under our sink and some drawers , she has promissed to have a pest control company every month and so far I only seen them once.
we offred to fix whats wrong woth the house as long as she deducts from rent she said ok , but when we told her how much they said it would be she said oh never mind i’ll find some one else..so we wrote a email to tell her that if she dont fix we dont pay , or let us fix.
when we were looking the place was being remodeled , my place was not done yet , i live in duplex and the place next to me was very nice , they had just finished it .
We had lived 150+ miles away from here , so we were not able to be coming to check on place, dumb us belived that everything was gonna be done like the home next door,its like they fix what was noticeable we had already gave deposit and first.

I have signed a year long lease for an apartment in a college town, it is snow the second week of school. My roommate and I are having an AWFUL time here and we would really like to get out of our lease. Here are some of the issues we are facing:
1. There is black mold in the bath tub and brown mold growing on the cieling above the tub
2. Our stove is constantly hot to the touch, as in it burns your hand if you touch it even if you have not used it all day. They claim they had it looked at and the heat is caused by the pilot light and there is nothing they can do.
3. Ocassionally we smell gas coming from the stove, even though we dont turn it on
4. Our oven does not work. at all.
5. We have no screens in two of our windows, causing bugs to get in
6. The railing on our outside 3 story staircase is loose.
7. The light fixture at the top of said staircase is so old that the screw is rusted over and we cannot change the broken light bulb, so we are left to climb the stairs with the loose railing in the dark at night.
8. The provided "parking" which we had to pay an additional 50$ each for, consists of total strangers blocking in your car as double parking is encouraged, and my car has been blocked in for a total of 12 hours at a time before, not to mention they do not enforce the parking pass rule
9. The smoke detector does not work
10. The power randomly goes off and then on again
11, Their painters left sharpie marks all over the walls
thats all i can think of for now, but i swear there is something new every day. my roomate and i each pay 350$/ month, which does not include utilities. I really need help getting out of this lease, and if anyone sees anything i could do PLEASE let me know. I made a huge mistake with this place and would greatly appreciate any help you could offer. thank you!!

Can my ex landlord sue me for an illegal apartment?
My roommate and I have moved into a horrible apartment about a year ago. It was our first apartment which we picked by ourselves and we were in a rush to move because our lease in our other apartment was running out and we did not renew it.
We do have plenty of witnesses for the apartment. But no pictures.
This apartment was a complete disaster. The windows were illegal, there was no smoke detector, the kitchen was carpeted and disgusting, the sink had a horrible clog, the front of the house was piled with junk, there were mice droppings in the stove, there were bugs everywhere, and the electric in the house was not running too well. We also heard that there was an electrical fire on the other side of the house while we were gone, in another tenant’s apartment and we didn’t know about it, and when we rented it they told us what to say if someone comes asking questions about the apartment because it was illegal. We did take pictures but now those pictures are pretty much long gone.
Does anyone have any advice about what I can do? They are suing us for 2600 saying that we destroyed carpet (we asked him if we can pick up some of the carpet to see if we can get rid of it and if the floor was savable), we left the apartment a mess meanwhile there were piles of junk and the woman (2nd landlord) who moved out left tons of junk that she did not want in the apartment.
I forgot to add that we did move in knowing all this under the condition that the day we moved in everything was to be cleared and cleaned. (Rent was payed already before we moved in). The woman who was in charge of the apartment moved out and moved to California. She left a lot of her things in the apartment. Her ex husband (the other landlord) told us that he will fix all these problems within the week. We kept pressing him and pressing him to fix everything but he never did and all he did was be a creeper, a peeping tom, and complain about his chronic fatigue.
More details sorry. I do not have access to the apartment anymore to take pictures. I have moved out a year ago. Someone else has lived in the apartment since and this is the first time he has contacted us in a year.

Why do I hallucinate at night?
Once or twice a week, I wake up in the dead hours of the night in a slightly more than half awake state and see things that scare me. It’s been as freaky as seeing a man with no face waving at me inside of my closet which magically flung open. I’ve also had some amusing ones where I think that the blinking smoke detector, for example is a laser beam and actually see a green laser coming in my direction ready to kill me. I thought I saw a cat in my closet last night when my actual cat was beside me, and hallucinated again the night before, thinking that my cat’s crinkle balls were moving on their own and trying to kill me.
I also have these feelings of dread sometimes, where I feel as though I’ll die if I don’t leave the room immediately. Whenever I hallucinate, I always run into the bathroom for some reason, and stay there for a minute while I regain my senses.
These hallucinations are vivid. When I thought I saw swarms of red aphids on my bed, I could see them so clearly. I jumped up, told my girlfriend that there were bugs in the bed, and tried to kill them until I realized a minute later that nothing was there. I couldn’t even see red since it was so dark, but I saw it as though the room was brightened by sunlight. I’m not on drugs, so what could this be? It takes anywhere from 10 seconds to a minute to realize when I’m in the bathroom that none of this is real.
